1. GENERAL INFORMATION AND REGISTRATION
1.1 Tom Tailor E-Commerce GmbH (hereinafter referred to as “Tom Tailor”) operates the Tom Tailor CLUB loyalty program (hereinafter referred to as “CLUB”) and provides program participants (hereinafter referred to as “CLUB Members”) with the program described below and, if available, a CLUB Card free of charge.
1.2 The following Conditions of Participation govern the contractual relationship (hereinafter referred to as “Membership”) between you as a CLUB Member and Tom Tailor as the Provider. To participate in the CLUB, you must have a CLUB account in the Tom Tailor online store. You can create this directly at the URL https://www.tom-tailor.eu by clicking on the "person" icon in the top right-hand corner of the header and clicking on Register, or directly at the following URL Registration. The prerequisite for this is that you have a valid e-mail address. Your e-mail address must be kept up to date during your membership and is a necessary condition for participation in the CLUB. You will be made aware of these conditions of participation before you register. By registering a CLUB account, you automatically become a CLUB member. You can also complete this registration via the Tom Tailor app (Apple and Android) or use the digital registration options in the store.
1.3 You can access the CLUB account via the online store or via the Tom Tailor app. You will receive an individual CLUB ID and, if available, a physical CLUB Card with your CLUB ID on it when you register in the store.
2. ELIGIBILITY REQUIREMENTS AND OBLIGATIONS TO COOPERATE
2.1 Any natural person resident in the EU who has reached the age of 18 is eligible to participate.
2.2 Legal representatives and employees of Tom Tailor GmbH and its affiliated companies can collect points, but cannot take advantage of any CLUB benefits (discounts, vouchers, etc.).
2.3 Each CLUB Account is personal, meaning that each natural person may only be the holder of one CLUB Account. Therefore, a CLUB Account may not be shared by more than one person.
2.4 You are responsible for any misuse of your CLUB Account by third parties in case you were responsible for the loss of ownership of the account. This therefore means that you are responsible for taking all steps to ensure the security and confidentiality of login details such as email address and password. We recommend that you use a password that you do not use for other accounts at the same time. If your password or account has been hacked, contact customer service immediately. You will find the contact details at the end of the Terms of Service.
2.5 You undertake not to violate any applicable legal provisions and any contractual provisions when communicating with us. This obligation includes, among other things: refraining from violating the rights of third parties, in particular property and personal rights, patent and trademark rights and other rights; you also undertake to comply with the applicable criminal laws and to refrain from racist, grossly offensive, pornographic or sexual, youth-endangering, extremist, violence-glorifying, promoting a prohibited political association, inciting to commit a crime, defamatory statements, insulting or other punishable content. Violations of this can be punished with extraordinary termination in accordance with Clause 4.
2.6 Please notify us immediately of any loss, theft or other disappearance of the CLUB Card. Credited points and benefits will be retained.
3. COLLECTING AND REDEEMING POINTS
3.1 You can collect points with every purchase using your CLUB ID. Points can be collected both in the online store and in participating stores (see section 3.5). To collect points in the store, you must either use your CLUB Card or have your CLUB ID scanned via the app. You automatically collect points in the online store if you are logged into your CLUB account and are a CLUB member when you make a purchase. Your points are automatically credited 30 days after the purchase, provided that the respective purchase contract is not canceled during this time.
3.2 With the CLUB, you always automatically collect 10 points for two types of points with every purchase (as described in section 3.1) for every euro of purchase value (section 3.3): Firstly, Level Points and secondly, Redeemable Points.
3.2.1 Level Points: CLUB members are assigned to different levels depending on how many Level Points they have collected. You therefore need Level Points to reach the next higher level in the CLUB. The higher your level, the better your benefits (e.g. discounts, deals and other benefits). Your Level Points will expire at the end of the month after 12 months from the date of purchase. As soon as you have collected enough Level Points for the next higher level, you will automatically move up the moment the Level Points are credited and keep this level for 12 months, regardless of whether older Level Points would have expired earlier during these 12 months since reaching the higher level. This means that there is a requalification phase during the 12 months after reaching the level, during which you can collect points to be able to keep the level after the end of the requalification phase. As soon as you have collected enough Level Points to reach the next higher level, you will automatically reach the next higher level and the requalification phase will start again for 12 months from this point. If you are unable to maintain your level after the 12 months because too many points will have expired, you will be downgraded again according to your points at the end of the phase. You can find your current level, the expiry periods and further explanations in your CLUB account. You can also find questions and answers in the FAQ section. The exact conditions may be subject to change in the future.
3.2.2 Redeemable points: You can use your redeemable points to redeem certain benefits. Redeemable points expire at the end of the month after 24 months from the date of purchase. To redeem these benefits, you must redeem the points for a specific benefit in the Tom Tailor app or in your CLUB account. Once redeemed, benefits can no longer be exchanged or refunded for points. Once you have redeemed points for benefits, the benefit must be activated in the app or CLUB account before use. After activation, you will receive a QR code and a number that you can scan or enter during the payment process so that the benefit can be used for this purchase. Redeemable points expire after use and will not be refunded if the contract is canceled. If activated benefits are not used within 7 days, they will also expire and no redeemable points will be refunded. Redeemable points can also be earned through certain promotions, e.g. as a welcome bonus.
3.3 The purchase value for the calculation of points is calculated based on the total value of the goods minus redeemed value/gift vouchers, shipping costs and any discounts.
3.4 If you cancel a purchase contract (withdrawal, return, exchange, complaint, etc.), the points credited for the purchase will be deducted from your CLUB account.
3.5 You can collect points in the Tom Tailor online store and in the following participating Tom Tailor stores in Germany, Austria, Switzerland, the Netherlands, Belgium, the Czech Republic, Poland and Hungary and also redeem benefits across countries: German stores; Austrian stores; Swiss stores; Dutch stores; Belgian stores; Czech Republic, Poland, Hungary. The collection of points and redeemability of benefits may be restricted as part of promotions. Please check the respective promotion conditions.
4. CANCELLATION
4.1 You can terminate your CLUB membership at any time without notice directly in your CLUB account or by e-mail e-shop.eu@tom-tailor.com
4.2 Tom Tailor is entitled to terminate your membership at any time without notice if there is good cause (in particular in the event of violations of Section 2 of the Conditions of Participation). In the absence of good cause, Tom Tailor may terminate your membership with three months' notice. This termination can be made by e-mail.
4.3 In the event of termination, benefits remain valid until the date of termination. Points on your CLUB account expire at the time of termination of membership without entitlement to reimbursement or payment.
4.4 If you do not collect any points within a period of two years from the last purchase date, Tom Tailor is entitled to delete your CLUB account.
5. CHANGES TO THE CLUB / TERMS OF SERVICE
5.1 Tom Tailor reserves the right to discontinue the program at any time by giving reasonable notice or, if there is an important reason, without giving such notice. Changes or additions, in particular to the points system or the benefits, can be announced within the CLUB account or by e-mail without giving reasons and with reasonable notice. This also applies in particular to additional benefits granted by Tom Tailor to CLUB members.
5.2 Tom Tailor also reserves the right to amend or supplement these Terms of Service if this serves to improve the use of membership for the benefit of CLUB Members or is necessary for simpler and more secure processing, in particular to prevent misuse. Your claims that have already arisen at the time of the change to the conditions of participation remain unaffected. You can view the current status of the Terms of Service at any time at www.tom-tailor.eu.
5.3 You will be notified of changes to the conditions of participation by email. A change is deemed to have been approved if you do not cancel your participation within one month of the date of notification or if you use your CLUB ID before this period expires.
